TEXT ORDER: The Court has reviewed the Plaintiff's Complaint #1 . Insofar as the Plaintiff sues individually and "as Executor of the Estate of Tammy Jo Hoopingarner," 28 U.S.C. 1332(c)(2) provides that "the legal representative of the estate of a decedent shall be deemed to be a citizen only of the same State as the decedent...." The Plaintiff alleges that the decedent was a "resident" of Bartonville, Illinois. The citizenship of an individual is based upon domicile, not on residence. America's Best Inns, Inc. v. Best Inns of Abilene, L.P., 980 F.2d 1072, 1074 (7th Cir. 1992). The Plaintiff is directed to file an amended complaint by 5/28/2021 that adequately alleges the factual basis for this Court's jurisdiction. Entered by Magistrate Judge Jonathan E.
