TEXT ORDER entered by Chief Judge Sara Darrow on January 3, 2022. Plaintiff #10 moves for a two-week extension of his deadline to respond to Defendant's #5 motion to compel arbitration. Plaintiff requests the extension because his counsel fell ill after receiving his COVID-19 booster vaccine. Mot. Ext'n Time 6. However, Plaintiff also concedes that his counsel was "able to expend a significant amount of time on this matter" after recovering from his illness, particularly in the four days preceding the response deadline of January 3, 2022. Id. at 12. Indeed, Plaintiff's motion to extend contains multiple pages of substantive argument opposing Defendant's arbitration motion. See id. at 7-11. In light of all these circumstances, the Court GRANTS IN PART Plaintiff's #10 motion and extends the response deadline by one week. The deadline for Plaintiff's response is now January 10, 2022. However, the Court notes it will only consider Plaintiff's response in deciding on Defendant's #5 motion to compel. All arguments opposing Defendant's motion must be included in Plaintiff's response: The Court will not consider Plaintiff's "preliminary objection" separately. (MLM) |
