January 14, 2022 Opinion or Order TEXT ORDER entered by Judge James E. Shadid on 1/14/2022. On January 5, 2020, Plaintiff filed a document entitled Motion to Intervene #1 . The document did not identify a case number and was therefore filed as a new complaint pursuant to 42 U.S.C. Sec. 1983. However, on January 6, 2022, the Court noted the deficiencies in Plaintiff's filing and gave him additional time to file an amended complaint and either pay the filing fee in full or file an IFP motion. See January 6, 2022, Text Order. Plaintiff has now responded with a motion to dismiss #4 . Plaintiff says he did not intend to file a lawsuit, he was instead trying to file an update in Rasho v. Walker, Case No. 07-1298. The Court will grant Plaintiff's motion to dismiss this lawsuit #4 and the Court will waive the filing fee. However, Plaintiff is admonished he MUST include a case number if he intends to file in a pending case. In addition, Plaintiff is represented by counsel in Rasho and therefore he should notify his attorney of any updates. (SAG)

January 6, 2022 Opinion or Order Filing 3 TEXT ORDER entered by Judge James E. Shadid on 1/6/2022. Plaintiff filed a document entitled Motion to Intervene which has been filed as a complaint. See Bahler v Lopez, 2007 WL 1375924 (7th Cir. May 10, 2007)(clerk may not refuse pro se plaintiff's initial submission for failing to follow Fed.R.Civ.P 8). There are several problems with Plaintiff's filing. First, if Plaintiff is requesting damages or Court action, he must first file a complaint clearly identifying the Defendants and his claims. Plaintiff must name or describe the specific individuals at Pontiac Correctional Center who are responsible for his claims. Plaintiff must also provide time frames for his allegations. Second, to proceed with a lawsuit, Plaintiff must either pay the $402 filing fee or file a motion to proceed in forma pauperis. Therefore, the Court will allow Plaintiff 21 days to file an amended complaint and either pay the filing fee or file an IFP motion. The Clerk is to provide Plaintiff with complaint and IFP forms for assistance. If Plaintiff fails to take any action within 21 days or on or before January 27, 2022, his case will be dismissed.
