TEXT ORDER entered by Judge Sue E. Myerscough on 2/1/2022 granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $38.85. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. TEXT ORDER entered by Judge Sue E. Myerscough on 1/20/2022. Plaintiff filed a complaint from Tazewell County Jail on January 18, 2022 in which he appears to alleges that his hand was fractured during his arrest in December 2020 and he then received inadequate medical care at the Tazewell County Jail for the injury. He also alleges that an officer at the Jail, Defendant Williams, exacerbated the injury by slamming the door of a food slot on Plaintiff's hand in May 2021. This complaint is in line for a merit review order pursuant to 28 U.S.C. Section 1915A. Plaintiff has also filed a motion for emergency protective order seeking an order requiring Defendant Williams to stay 500 feet away from Plaintiff. The Court construes the motion as a motion for a temporary restraining order. The motion is denied #5 because Plaintiff's factual allegations do not support Plaintiff's conclusion that Plaintiff is in any current danger of harm from Defendant Williams. (KB) |
