Filing 6 NOTICE of Appearance of Attorney by David C Van Dyke on behalf of Agri-Systems, Inc. (Van Dyke, David) |
Filing 5 AMENDED COMPLAINT FOR DECLARATORY AND INJUNCTIVE RELIEF against All Defendants, filed by Agri-Systems, Inc.. (Attachments: #1 Exhibit 1-11, #2 Exhibit 12-15)(Gifford, Michael) |
TEXT ORDER: The Court's 3/22/2022 order to show cause is DISCHARGED. The Plaintiff's counsel has sufficiently explained the basis for filing this case in the Urbana Division of this Court in his Response #4 , and the Court finds the Urbana Division is, indeed, the proper division pursuant to Civil LR 40.1(D). As the Peoria Division was simply inadvertently selected when filing the Complaint, the Court directs the Clerk to TRANSFER this case to the Urbana Division of this Court. Entered by Magistrate Judge Jonathan E. Hawley on 3/23/2022. (KZ) |
Filing 4 RESPONSE TO ORDER TO SHOW CAUSE by Agri-Systems, Inc. . (Gifford, Michael) |
Set Deadlines: Show Cause Response due by 3/29/2022. (JS) |
TEXT ORDER: The Plaintiff filed its Complaint #1 in the Peoria Division of the U.S. District Court for the Central District of Illinois. The caption of the Complaint indicates the Urbana Division of this Court. The Plaintiff alleges in the Complaint that venue is proper in this Court "in that a substantial part of the events giving rise to this claim occurred in this district, and that the primary offices of Defendants are within this district." However, the Plaintiff does not state, as part of the statement of jurisdiction, the basis for filing in the Urbana Division specifically. See Civil LR 40.1(F). Given who the Defendants are, coupled with the Plaintiff's indication on the Civil Cover Sheet #3 that Sangamon County, Illinois is the county of residence of the first listed Defendant, it is unclear that the Urbana Division is the correct division in which this case should have been filed per the Local Rules. In light of all this, the Plaintiff is ordered to show cause in writing, by 3/29/2022, why this case should not be transferred to the Springfield Division of the U.S. District Court for the Central District of Illinois. Entered by Magistrate Judge Jonathan E. Hawley on 3/22/2022. (KZ) |
