TEXT ORDER entered by Judge Sue E. Myerscough on 5/16/2022. The Court DENIES Plaintiff's Petition to Proceed in Forma Pauperis #5 . On January 18, 2022, Plaintiff filed his complaint in the Northern District of Illinois ("NDIL"). On that date, Plaintiff spent $138 in commissary items, leaving him a trust fund balance of $964. (ECF 17: p. 2.) Up to that point, Plaintiff's trust fund balance for the preceding six months averaged well over $1,000 #17 . On April 18, 2022, NDIL transferred Plaintiff's case to this Court. In April 2022, Plaintiff spent an additional $337 on commissary items, which left him $837 in his trust fund as of April 13, 2022. Accordingly, because Plaintiff had not shown that he is impoverished, the Court DIRECTS Plaintiff to pay the $402 filing fee within fourteen days of the entry of this order. See Merritte v. Templeton, 493 F. Appx 782, 784 (7th Cir. 2012) ("A litigant wishing to proceed in forma pauperis must show that he is unable to pay required filing fees."). Failure to comply will result in the dismissal of this case without prejudice. (KE)
