May 12, 2022 Opinion or Order TEXT ONLY ORDER: In his response to the order to show cause why this case was filed in the Peoria Division, Plaintiff indicates that he resides in Ottawa, Illinois and the "nearest federal courthouse" is in Peoria, Illinois. However, Ottawa is located in LaSalle County. 28 U.S.C. 93(a) provides LaSalle County is in the Northern District of Illinois. Additionally, Local Rule 40.1 specifies the counties in the Central District of Illinois; LaSalle County is not one of them. Therefore, the Court finds that venue is proper in the Northern District of Illinois because Plaintiff resides in Ottawa, Illinois, and the Complaint describes events that occurred in Lasalle County, Illinois. As such, pursuant to 28 U.S.C. 1404, the Clerk is directed to TRANSFER this matter to the Northern District of Illinois. Entered by Judge James E. Shadid on 5/12/2022. (GN)

May 5, 2022 Opinion or Order TEXT ORDER: The Plaintiff's Complaint #1 alleges that venue is proper in this district because "a substantial part of the events giving rise to this claim occurred in this District." However, Local Rule 40.1(F) provides that, additionally, "As part of the statement of jurisdiction, the initial pleadings in each case must state the basis for filing in the division selected." Local Rule 40.1 provides the divisions of the U.S. District Court for the Central District of Illinois in which complaints and subsequent filings will be filed. See Civil LR 40.1(A)-(D). The Complaint does not state, as part of the statement of jurisdiction, the basis for filing in the Peoria Division. In light of this, the Plaintiff is ordered to show cause in writing, by 5/19/2022, why this case was filed in the Peoria Division of the U.S. District Court for the Central District of Illinois.
