TEXT ORDER entered by Judge James E. Shadid on 7/1/2022. The Court has received a pro se complaint filed on behalf of Inmate Carlos Padilla and "similarly situated individuals." (Comp., p. 1). At the conclusion of the complaint, there is a list of 21 "printed inmate names and ID numbers." (Comp, p. 4). This is not sufficient. Any document filed on behalf of multiple plaintiffs must include the signature of each litigant. For instance, it is unclear from the document filed whether the listed individuals are aware a lawsuit has been filed on their behalf. Particularly concerning, many of the printed names appear to be in the same handwriting. (Comp., p. 4). Since it is only apparent Plaintiff Padilla intended to file this lawsuit, he is currently listed as the only Plaintiff. However, if Plaintiff wishes to file an amended complaint on behalf of all named individuals, he must do so within 21 days of this order. The amended complaint must include all claims against all named Defendants and must not refer to the original complaint. Plaintiff should use the standard complaint form which asks for both a list of Plaintiffs and a list of Defendants. At the conclusion of the amended complaint, each Plaintiff who wishes to participate must sign with their handwritten signature indicating they have reviewed the contents and intended to be named as a Plaintiff. See Fed.R.Civ. P. 11 (a); (b). Each Plaintiff is also responsible for full payment of the filing fee. Therefore, each Plaintiff must either pay the $402 fee or file a motion to proceed in forma pauperis. Finally, the complaint mistakenly states exhaustion of administrative remedies does not apply. Each Plaintiff must be able to demonstrate they fully exhausted their administrative remedies before this complaint was filed. Therefore, a new complaint signed by all intended Plaintiffs must be filed on or before July 22, 2022, or the case will proceed with only Plaintiff Padilla. Plaintiff Padilla, or any other named Plaintiff, must either pay the filing fee in full or file a motion to proceed in forma pauperis on or before July 22, 2022, or the case will be dismissed. The Clerk is to provide Plaintiff Padilla with complaint and IFP forms for his assistance.(SAG)
