TEXT ORDER Entered by Chief Judge Sara Darrow on 11/18/22. Petitioner has filed a 2241 Petition #1 , which includes a request for the Court to appoint counsel. The Court has reviewed this Petition pursuant to 28 U.S.C. 2243, 2241, and Rule 4 of the Rules Governing Section 2254 Proceedings for the United States District Courts and declines to summarily dismiss the petition. Further, a district court may appoint counsel to any financially eligible person seeking relief under 28 U.S.C. 2241 if the interests of justice so require. 18 U.S.C. 3006A(a)(2)(B). Here, because the Court finds that the issue is quite complex and not adequately presented in the Petitioners filing, the Court finds that it is in the interests of justice to appoint counsel. Accordingly, the Court APPOINTS the Federal Public Defender to represent Petitioner in this proceeding. The Clerk is DIRECTED to notify the Federal Public Defender Office and ADD the Federal Public Defender as counsel of record for Petitioner. If warranted, Petitioner's counsel may file an amended petition on or before December 23, 2022. Respondent shall file a response on or before January 27, 2023. (ANW) |
