October 31, 2022 Opinion or Order Filing 9 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 10/31/2022. Plaintiff's motion for clarification #4 is GRANTED. Plaintiff's motion for a temporary restraining order or preliminary injunction #1 is DENIED. This case is DISMISSED WITHOUT PREJUDICE because the Court lacks subject matter jurisdiction. 28 U.S.C. Sections 1331-1332. Further amendment to this case would be futile because this case is governed by the Prison Litigation Reform Act, and Plaintiff has admitted that he did not comply with the PLRA's exhaustion requirements before filing this case. 42 U.S.C. 19997e(a). The Clerk of the Court is directed to enter judgment in Defendants' favor and against Plaintiff. All other pending motions are denied as moot, and this case is terminated. All deadlines and settings on the Court's calendar are vacated. If he wishes to appeal this judgment, Plaintiff must file a notice of appeal with this Court within thirty (30) days of the entry of judgment. Fed. R. App. P. 4(a)(4). If he wishes to proceed in forma pauperis on appeal, Plaintiff's motion for leave to appeal in forma pauperis must identify the issues that he will present on appeal to assist the Court in determining whether the appeal is taken in good faith. October 26, 2022 Opinion or Order TEXT ORDER granting #5 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 10/26/2022. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $7.60. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 11/25/2022. (KE)
