TEXT ONLY ORDER: On October 6, 2022, Plaintiffs filed a Motion for Temporary Restraining Order (Doc. 3) and, on October 19, 2022, a memorandum in support (Doc. 4). On November 2, 2022, Defendants filed a response (Doc. 6). In the response, Defendants point out that Plaintiffs' motion does not discuss the elements required for a TRO to issue, that; (1) there is some likelihood of success on the merits, (2) no adequate remedy at law exists, and (3) Plaintiffs will suffer irreparable harm if the injunction is not granted. Ty, Inc. v. Jones Group, Inc., 237 F.3d 891, 895 (7th Cir. 2001). Defendants further note that in another vaccination case, the same counsel filed a Motion for TRO without discussing these necessary elements. Boone, et al., v. IDOC, et al., No. 21-3229 (C.D. Ill. Dec. 6, 2021). There, the Court noted the deficiency, striking the Motion (Doc. 10), with leave to refile. For these same reasons, Plaintiffs' Motion for TRO (Doc. 3) is STRICKEN with leave to refile within 14 days. Entered by Judge James E. Shadid on 11/18/2022. (EE)
