TEXT ORDER: The Court has reviewed the Plaintiffs' Amended Complaint #3 in which the Plaintiffs state their claims are properly filed in the Peoria Division of this Court pursuant to Local Rules 40.1 and 42.1 because they are related to the claims in Boone et al v. IDOC, 3:21-cv-03229-JES JEH and Gray et al v. Pritzker et al., 1:22-cv-01342-JES-JEH. Neither Civil Local Rule 40.1 nor 42.1 provide that a case is to be filed in the division where related cases are pending. Rather, Civil Local Rule 40.1 provides that complaints "which arise from" any of the listed counties in a particular division are to be filed in that division. Civil LR 40.1(A)-(D). Civil Local Rule 42.1 provides that when counsel for a party knows that a newly filed case is related to another case already pending in the district, the party is responsible for bringing the matter to the court's attention, that consolidation "will be considered," and that later-filed cases "may be transferred[.]" Civil LR 42.1 (emphasis added). Because the allegations of the Amended Complaint do not indicate that this case arises from one or more of the counties in the Peoria Division but do indicate that Defendant Miller is the director of McFarland Mental Health Center which is in Sangamon County, Illinois (within the Springfield Division), and the Civil Cover Sheet lists Sangamon County as the county of residence of the first listed Defendant, the Clerk is directed to TRANSFER this case to the Springfield Division of the U.S. District Court for the Central District of Illinois. In fact, no division is identified in the caption of the Complaint (in violation of Civil Local Rule 40.1(E)), and the allegations of the Complaint do not otherwise indicate that this case arises from one or more of the counties in the Peoria Division. The Civil Cover Sheet attached to the Complaint lists Sangamon County as the county of residence of the first listed Defendant. Sangamon County is within the Springfield Division of this Court.
