December 27, 2022 Opinion or Order Filing 11 TEXT ORDER: Court docket entry has been returned as undeliverable. Within 14 days of the entry of this order, plaintiff is directed to show good cause why this case should not be dismissed for failure to keep the Court informed of plaintiff's address. December 6, 2022 Opinion or Order TEXT ORDER entered by Judge James E. Shadid on 12/6/2022. On November 15, 2022, the Court allowed Plaintiff until December 6, 2022, to clarify whether he intended to file a lawsuit. See November 15, 2022, Text Order. If he did wish to pursue a lawsuit, Plaintiff was directed to either pay the filing fee or file a motion to proceed in forma pauperis (IFP) and file a complaint clearly articulating his claims and Defendants. On November 22, 2022, Plaintiff filed a complaint against three Defendants and motion to proceed IFP #4 , #5 . On December 5, 2022, Plaintiff filed a different motion for leave to amend and motion to proceed IFP #7 , #8 . Plaintiffs' second motion to amend includes additional defendants. The second motion for leave to amend supersedes the first motion. Therefore, the Clerk is directed to strike the first proposed amended complaint #4 and the Court will instead review the claims in the second proposed amended complaint #7 . Plaintiff has failed to use the IFP form provided to him and therefore he has not provided the required information. Both of Plaintiff's IFP motions are denied #5 , #8 . The Clerk is to again provide Plaintiff with an IFP form. Plaintiff MUST file out this IFP form and return it to the Court within 14 days or on or before December 21, 2022. If Plaintiff fails to file a proper IFP form, his case will be dismissed for failure to pay the filing fee. Finally, Plaintiff has filed a motion for a subpoena which asks the Court to provide him unspecified video footage, recorded calls between Plaintiff and A. Borris, and unspecified hospital footage #6 . Plaintiff has not adequately explained what he is seeking or how it is relevant to his claims, not has he identified the recipient of any subpoena. In addition, the Court must first review the claims in Plaintiff's compliant and the Defendants must be served before the discovery period begins when Plaintiff may request relevant information including videos to support his claims. The motion is denied #6 .(SAG)

November 15, 2022 Opinion or Order TEXT ORDER entered by Judge James E. Shadid on 11/15/2022. Plaintiff has filed a document entitled Motion for Witness Statement, but he has no pending lawsuits in the Central District of Illinois. In an abundance of caution, the Court has filed Plaintiff's motion as a complaint pursuant to 42 U.S.C. 1983 #1 . See Bahler v Lopez, 2007 WL 1375924 (7th Cir. May 10, 2007)(clerk may not refuse pro se plaintiff's initial submission, a letter, for failing to follow Fed.R.Civ.P 8). However, it is not clear to the Court whether the Plaintiff intended to open a lawsuit. Therefore, the Court will allow the Plaintiff 21 days to clarify his intentions. If the Plaintiff DID intend to file a lawsuit, he must file a complaint clearly setting forth his claims and Defendants on or before 12/6/2022. Plaintiff must also either pay the $402 filing fee in full or file a motion to proceed in forma pauperis (IFP) on or before 12/6/2022. If the Plaintiff did NOT intend to open a lawsuit, he MUST state so in writing on or before the 12/6/2022 deadline. The Court will then dismiss this lawsuit and no filing fee will be owed. Finally, Plaintiff is admonished if he fails to take any action by the 12/6/2022 deadline, then the Court will assume Plaintiff did intend to open a lawsuit and he will be responsible for the $402 filing fee even if his case is later dismissed. The Clerk is to send the Plaintiff a blank complaint form and IFP form to assist him. (SAG)
