Sec 1915A; Fed. R. Civ. P. 12(b)(6). Although the Court gave Plaintiff leave to file a proposed amended complaint, Plaintiff has failed to file a proposed amended complaint by the deadline given by the Court for him to do so. Accordingly, this case is closed and is dismissed without prejudice. All pending motions are denied as moot. The Clerk is directed to enter a judgment pursuant to Federal Rule of Civil Procedure 58. The Clerk of the Court is directed to add this case to the three-strikes list against Plaintiff. 28 U.S.C. 1915(g). If he wishes to appeal this dismissal, Plaintiff must file a notice of appeal with this Court within thirty (30) days of the entry of judgment. Fed. R. App. P. 4(a). See written order. (KE)
