TEXT ORDER Entered by Judge James E. Shadid on 1/31/23. Plaintiff filed his complaint on December 28, 2022 #1 . On January 13, 2023, the Court dismissed Plaintiff's complaint as a violation of Federal Rule of Civil Procedure 8 and allowed him time to file an amended complaint. See January 13, 2023, Merit Review Order. Plaintiff then filed a motion for leave to amend. The Court has not yet reviewed the claims in the proposed amended complaint. Plaintiff has now filed a motion for continuance #10 . The motion is denied as moot #10 . There are no deadlines set in this case. (ANW)

TEXT ORDER entered by Judge James E. Shadid on 1/24/2023. On January 13, 2023, the Court dismissed Plaintiff's complaint as a violation of Federal Rule of Civil Procedure 8 and allowed him one final opportunity to file an amended complaint. See January 13, 2023, Merit Review. Plaintiff has filed a proposed amended complaint which the Court will review. However, Plaintiff has also filed a motion to send legal mail and a motion to release information #8 , #9 . Plaintiff's first motion complains that the Peoria County Jail does not consistently provide him an "indigent pack" for legal mail #8 . Plaintiff's motion is not sufficient. Plaintiff must first address this issue in the jail grievance process. He may then choose to file a separate lawsuit concerning this claim. If Plaintiff is prevented from filing a document in a specific, pending case, he may file a motion in that case explaining specifically what he was unable to file. The motion is denied #8 . Plaintiff's second motion asks the Court to order the Sheriff to release unspecified information to him #9 . Plaintiff claims jail staff is preventing him from meeting deadlines or filing complaints. Again, Plaintiff must address his complaints through the grievance process, and if appropriate through a separate lawsuit or a motion in a specific case in which he was unable to meet a deadline. MERIT REVIEW ORDER entered by Judge James E. Shadid on 1/13/2023. Plaintiff's complaint is dismissed as a violation of Federal Rule of Civil Procedure 8. The Court will allow Plaintiff one opportunity to file an amended complaint clarifying his claims. Plaintiff must file his proposed amended complaint on or before February 2, 2023 and MUST follow the Court's directions concerning the information provided in his complaint. If Plaintiff fails to file his amended complaint on or before February 2, 2023 or fails to follow the Court's directions, his case will be dismissed. Plaintiffs Motion for Appointment of Counsel is DENIED with leave to renew after Plaintiff clarifies his allegations and the involvement of the named Defendants. #4 . TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $15.50. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 1/30/2023.
