Filing 4 ORDER entered by Judge James E. Shadid on 1/13/2023. IT IS THEREFORE ORDERED:1) The Clerk of the Court is directed to dismiss Davis v Jerome Combs, Case No. 23-1009 and Davis v. County of Kankakee, Case No. 23-1010 as repetitive of a previous lawsuit. No filing fee will be owed in either case. The Clerk is to send a copy of this order to the Trust Fund Department at Plaintiff's facility. 2) Plaintiff may instead proceed with his claims in his first lawsuit, Davis v. O'Neal, Case No. 22-2279, and he will be responsible for paying the filing fee in this case. 3) Plaintiff must file an amended complaint in his first lawsuit, Davis v. O'Neal, Case No. 22-2279, on or before February 3, 2023 which includes all claims and Defendants related to the September 2022 incident at the Jerome Combs Detention Center. The clerk is to provide Plaintiff with a new complaint form for his use. Plaintiff must label this document as an Amended Complaint and must include the Case No. 22-2279. 4) If Plaintiff fails to file his amended complaint in Davis v. O'Neal, Case No. 22-2279 by the February 3, 2023 deadline, he will be limited to his stated claims against Officer O'Neal, Shift Supervisor John Doe, and the jail. 5) The Clerk is to reset the internal merit review deadline in Davis v. ONeal, Case No. 22-2279 within 30 days of this order. SEE FULL WRITTEN ORDER.(SAG) |
Filing 3 TEXT ORDER entered by Judge James E. Shadid on 1/9/2023. Plaintiff has filed a Complaint but has not paid the $402 filing fee nor filed a petition to proceed in forma pauperis. Within 21 days of the entry of this order, Plaintiff must pay the $402 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914. The Clerk is directed to send Plaintiff the forms for proceeding in forma pauperis.(SAG) |
