TEXT ORDER entered by Judge James E. Shadid on 4/20/23: In the Court's April 19, 2023 Order #2 the Court summarily dismissed Petitioner's 2254 Petition for lack of jurisdiction. Should Petitioner wish to appeal this decision, he must obtain a certificate of appealability. 28 U.S.C. 2253(c)(1). A certificate may issue "only if the applicant has made a substantial showing of the denial of a constitutional right," 28 U.S.C. 2253(c)(2). This will hold true only when "reasonable jurists would find the district court's assessment of the constitutional claims debatable or wrong," Slack v. McDaniel, 529 U.S. 473, 484 (1995). The Court concludes Petitioner's claim does not meet this standard and accordingly DECLINES to issue a certificate of appealability.(FDS)
