TEXT ORDER: In its #5 Order, the Court dismissed some of Plaintiffs' claims with prejudice and others without prejudice, permitting Plaintiffs to seek leave to amend their Complaint as to the latter claims within 14 days. That period of time having expired without filing by Plaintiffs of a motion for leave to amend, this action is DISMISSED with prejudice. Fed. R. Civ. P. 41(b); see Link v. Wabash R. Filing 5 ORDER entered by Judge Joe Billy McDade on 4/24/2023. For the foregoing reasons, Plaintiff N.A.B. is dismissed from this case without leave to refile. Remaining Plaintiffs' claims for monetary damages on Counts 9, 12,and 15 against Defendants Eric Echevarria, Christopher Collins, and Angela Kramer are DISMISSED WITHOUT PREJUDICE. Plaintiffs' claims for monetary damageson Counts 9 and 15 against Defendants Jodi Melinda Hoos, Nine Rena Gougis, Hanna Maria Kong, and Chandra Lin Justice are DISMISSED WITHOUT PREJUDICE. All other claims are DISMISSED WITH PREJUDICE and all other Defendants terminated from the case. Plaintiffs' Motion to Proceed in forma pauperis (doc. 2) is DENIED as moot; their Motion for Emergency Injunctive Relief (doc. 4 at 12) is likewise DENIED as moot and because this Court lacks jurisdiction to issue the injunction sought. If Plaintiffs wish to file a second amended complaint, they must first seek and obtain leave of the Court to do so. Any such request must be made within 14 days of this order and accompanied by the proposed amendment, attached to the motion as an exhibit. See full written Order. (VH) |
