TEXT ONLY ORDER: On March 21, 2023, this Court entered an Order directing Plaintiff to show cause as to why this case should not be transferred to the Northern District of Illinois. On April 3, 2023, Plaintiff filed a response stating it had inadvertently determined Defendants residence in Monee, Will County, Illinois was in the Central District of Illinois. Plaintiff further agreed the case should be transferred to the Northern District of Illinois. Accordingly, the Clerk is DIRECTED to transfer this case to the Northern District of Illinois. See 28 U.S.C. 1404(a) (For the convenience of parties and witnesses, in the interest of justice, a district court may transfer any civil action to any other district or division where it might have been brought). TEXT ORDER: The Court is in receipt of Plaintiff's #1 Complaint for Declaratory Judgment Action regarding coverage of Defendant's injuries sustained in an automobile accident in Racine, Wisconsin on March 26, 2019. (D. 1). According to the Complaint, Defendant is seeking to recover damages under Underinsured Motorist insurance coverage in a Commercial Package Policy issued by Plaintiff to Defendants employer at the time of the accident. Id. Plaintiff alleges this Court has jurisdiction under 28 U.S.C. 1332(a), as the action is between citizens of different states. Id. at 4. Plaintiff is a corporation organized under the laws of Minnesota, with its principal place of business in Minnesota. Id. at 1. Defendant is a resident of Illinois. Id. Plaintiff further alleges [v]enue is proper in the Central District of Illinois, as [Defendant] resides in this District. Id. at 5. According to the Civil Cover Sheet, Defendant resides in Will County, Illinois, which is in the Northern District of Illinois. (D. 1-3). Plaintiff is therefore directed to show cause by 04/03/2023 why this case should not be transferred to the Northern District of Illinois. Entered by Judge Michael M. Mihm on 03/21/2023. (AH)
