Filing 12 JUDGMENT. (AH) |
Filing 11 AMENDED ORDER re #10 Order. (See full Order) Entered by Judge James E. Shadid on 8/28/2023. (AH) |
TEXT ONLY ORDER: On 7/7/23, Jamie Cosenza, a defendant in the Illinois state court action, removed the case to Federal Court and attached a Complaint in which she identified herself as the Federal Court Plaintiff. On 8/24/23, the Court entered an Order remanding the case to state court, adopting Ms. Cosenza's identification of the parties; she as the Plaintiff and DLJ Mortgage Capital Inc. as the Defendant #10 . The Court now finds this to be confusing and will amend that Order under separate cover to identify Ms. Cosenza as the Defendant and DLJ as the Plaintiff, consistent with the state court proceeding. The Clerk is to send a copy of this Order and the Amended Order to the state court. Entered by Judge James E. Shadid on 8/28/2023. (AH) |
Filing 10 ORDER granting #7 Motion to Remand. This cause is remanded to the Tenth Judicial Circuit, Peoria County, Illinois, without apportionment of costs or expenses. The District Clerk is to mail a certified copy of this order to the clerk of the state court. The state court may thereafter conduct all further proceedings in this case. All matters pending before this Court are rendered MOOT. (See full Order) Entered by Judge James E. Shadid on 8/24/2023. (AH) |
