TEXT ORDER STRIKING #3 the Plaintiff's Summons Returned Executed. It appears from the face of the Plaintiff's Attestations of Service as well as his Proof of Service that the Plaintiff himself served the Defendant. Fed. R. Civ. P. 4(c)(2) states, "Any person who is at least 18 years old and not a party may serve a summons and complaint." (emphasis added). The Plaintiff's #3 Summons Returned Executed is therefore STRICKEN, and the Plaintiff must properly serve the Defendant within the time set forth in Fed. R. Civ. P. 4(m).
