TEXT ORDER entered by Judge James E. Shadid on January 11, 2024: Upon reviewing the docket, the Court finds that Petitioner has incorrectly named the State of Illinois as Respondent. A Section 2254 Petition must be "directed to the person having custody of the person detained," 28 U.S.C. Section 2243, which "is the person having a day-to-day control over the prisoner." Robledo-Gonzales v. Ashcroft, 342 F.3d 667, 673 (7th Cir. 2003); see also, Rumsfeld v. Padilla, 542 U.S. 426, 435, 442 (2004); Wyatt v. United States, 574 F.3d 455, 45960 (7th Cir. 2009). Accordingly, as Petitioner is currently incarcerated at the Big Muddy Detention Center, the Clerk is DIRECTED to substitute the warden of this facility, Kimberly Hvarre, as Respondent. (VH) |

See Rules Governing Section 2254 Cases in the United States District Courts, Rule 2(e). Accordingly, the Clerk is DIRECTED to reopen this case and unstrike the #1 Petition. Additionally, the Court notes that Petitioner has not paid the filing fee. If Petitioner is unable to pay the required filing fee, he may file a Motion for Leave to Proceed in Forma Pauperis.
