Because of Plaintiff's history of filing frivolous and barebones complaints--she has had more than 30 complaints dismissed already this calendar year--the Court considers whether to take further action to restrict her filing privileges in a separate, miscellaneous action. April 5, 2024 Opinion or Order TEXT ORDER Entered by Judge James E. Shadid on 4/5/2024. Plaintiff has filed a Complaint #1 , a motion to proceed in forma pauperis #2 , and a motion for the appointment of counsel #3 . The IFP statute, 28 U.S.C. 1915(a)(1), is designed to ensure indigent litigants meaningful access to the federal courts. Neitzke v. Williams, 490 U.S. 319, 327 (1989). In cases asserted under 28 U.S.C. 1915, district courts must screen the case before granting the privilege to proceed without prepayment of fees. United States v. Durham, 922 F.3d 845, 846 (7th Cir. 2019) (citing 28 U.S.C. 1915(e)(2)). The Court is to review the pleadings and deny IFP status if: (1) the allegation of poverty is untrue; (2) the action is frivolous; (3) the action fails to state a claim; or (4) the action seeks monetary relief against an immune defendant. 28 U.S.C. 1915(e)(2). The Court believes it prudent to set a hearing as to the sufficiency of Plaintiffs Complaint. Accordingly, a hearing is set for Thursday 4/18/2024 at 9:00 AM in person in Courtroom A in Peoria before Judge James E. Shadid. Plaintiff is ordered to appear at that time.(ED) Modified on 4/8/2024 to reflect text order (ED).
