April 9, 2024 Opinion or Order TEXT ORDER: Plaintiff has filed a #2 Motion for Leave to Proceed in forma pauperis and a #3 Motion to Request Counsel in connection with his filing of a civil action. Plaintiff's #2 Motion was submitted under penalty of perjury and sufficiently demonstrated that he should be excused from paying the filing fee in this action. Thus, Plaintiff's #2 Motion is GRANTED, and he may proceed without paying the filing fee. With respect to his Motion to Request Counsel, "[c]ivil litigants do not have a constitutional or statutory right to counsel in federal court." Johnson v. Doughty, 433 F.3d 1001, 1006 (7th Cir. 2006). However, the Court may, in its discretion, request an attorney to represent an indigent litigant. 28 U.S.C. 1915(e)(1). Before the Court will recruit counsel, the litigant must first show he made a reasonable attempt to acquire counsel without court intervention and demonstrate the plaintiff is not competent to litigate the matter himself. Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007). Plaintiff's Motion fails to indicate whether he has sought representation. Because it is incomplete, Plaintiff's #3 Motion to Request Counsel is DENIED. This does not prevent Plaintiff from filing a future motion to request counsel. If he chooses to file such motion, he must comply with the instructions and answer all the questions. The Clerk is directed to mail Plaintiff a copy of this Order.
