May 30, 2024 Opinion or Order TEXT ORDER: On 04/22/2024, the Court received notice that the Clerk's attempt to deliver a copy of the #1 Petitioner and #2 IFP Motion to Petitioner were returned as undeliverable. See ECF No. 3. On 05/14/2024, the Court issued a Show Cause Order, in accordance with Local Rule 16.3(K), warning Petitioner that failure to provide notice of a change in address would result in dismissal of his case and providing Petitioner until May 28, 2024, to update his address. Text Order on 05/14/2024 (citing C.D. Ill. L. R. 16.3(K) ("Every pro se plaintiff must notify the clerk of this court in writing of any change of address during the entire pendency of his case. Failure to notify the clerk of a change of address will result in the dismissal of the case.")). To date, Petitioner has not filed an updated address and the deadline to do so has now passed. Accordingly, Petitioner's #1 2254 Petition is DISMISSED pursuant to Local Rule 16.3(K) and his #2 IFP Motion is DENIED as MOOT. The Clerk of Court is DIRECTED to close this case. May 14, 2024 Opinion or Order TEXT ORDER: On 04/22/2024, the Court received notice that the Clerk's attempt to deliver a certificate of mailing to Petitioner was returned as undeliverable. ECF No. 3. A review of the notice indicates that it was received by the McLean County Detention Facility and that Defendant is not there. Id. Central District of Illinois Local Rule 16.3(K) provides that "[e]very pro se plaintiff must notify the clerk of this court in writing of any change of address during the entire pendency of his case. Failure to notify the clerk of a change of address will result in the dismissal of the case." Within 14 days of the entry of this Order, Petitioner is DIRECTED to show good cause why this case should not be dismissed for failure to keep the Court informed of plaintiff's address. Failure to notify the Court of his new address will result in dismissal of this case. The Clerk of Court is DIRECTED to mail a copy of this Text Order to Petitioner's last known address.
