Text Only Order Entered by Judge James E. Shadid on 07/10/2024. On May 22, 2024, the Court denied Plaintiff's Petition to Proceed in forma pauperis #2 because his Complaint #1 failed to state a claim. The Court provided Plaintiff an opportunity to file an amended complaint within 30 days of the Order. And, the Court informed Plaintiff that failure to file an amended complaint would result in dismissal of his case, with prejudice. #4 . As Plaintiff has failed to file an amended complaint, his lawsuit is hereby dismissed with prejudice. The Clerk is directed to close this case. (DW)

Consequently, Plaintiff's request for counsel (Doc. #3 ) is DENIED as moot. Although it appears that Plaintiff may not state a claim under these facts, out of an abundance of caution, he will be given an opportunity to file an amended complaint within 30 days.
