TEXT ORDER entered by Judge Joe Billy McDade on 1/28/2025. On 1/7/25 the Court entered an Order directing Plaintiff to pay the filing fee by 2/10/25 or the case would be dismissed without prejudice. On 1/22/25 Plaintiff filed a Letter #10 stating that if the Court has not yet received his filing fee, he would like to dismiss this case without prejudice. The Court's Finance Department reports that no payment has been received as of this date. Service has not yet been effected on any party, so pursuant to Fed. R. Civ. P. 41 and Plaintiff's request, this action has been dismissed without prejudice. No judgment to enter. Clerk to close case. (KE)

Plaintiff should submit a check for the $405 that is due (or a request to proceed without prepayment of fees). Plaintiff allowed through 2/10/25 to do so if he still intends to pursue this action. If no payment is received the case will subject to dismissal without prejudice. (KE)
