August 13, 2025 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 8/13/2025. On 7/21/25, the Court entered an Order #11 allowing Plaintiff time to decide if Plaintiff wanted to pursue claims related to an elbow injury and claims related to denial of gender dysphoria care, or only one set of claims. Plaintiff's status reports #12 , #14 indicate Plaintiff wants to pursue both sets of claims and understands one set of claims will be severed into a new lawsuit with attendant filing fee requirements. The Clerk is directed to open a new lawsuit with Plaintiff as the Plaintiff and Mindi Nurse as the Defendant. The Clerk is to file the Complaint from this action as the initial pleading in that lawsuit. That new case will relate solely to Plaintiff's denial of gender dysphoria care claims. The Court will enter an order in that case related to the next steps therein. This case, 25-1090, will proceed as to Plaintiff's claim regarding alleged improper treatment of an elbow injury. Plaintiff is now allowed 21 days to file an Amended Complaint in this action, limited to Plaintiff's allegations related to the care of the elbow issue. Plaintiff must identify each Defendant that Plaintiff believes has violated Plaintiff's constitutional rights, and how, as to the elbow issue. Plaintiff cannot simply list Defendants and allege they were all involved. Plaintiff must specifically allege what each Defendant on the elbow care claim did or did not do. The Court will then enter an appropriate order regarding that claim. Failure to file an amended complaint within 21 days will subject this action to dismissal without prejudice for failure to prosecute. Finally, Plaintiff's Motion for Objection to Preserve the Record #13 objects to the Court's resolution of Plaintiff's challenge to certain Illinois statutes in its Merit Review Order #11 . No further motion is necessary to preserve the record as to that claim. The Motion #13 is DENIED. (VH)

July 21, 2025 Opinion or Order Filing 11 MERIT REVIEW ORDER entered by Judge Michael M. Mihm on 7/21/2025. IT IS THEREFORE ORDERED: 1. Plaintiff's Motion to Request Counsel #5 is DENIED. 2. Plaintiff's Motion to Consolidate Civil Complaint Claims Into One Filed Suit #6 is DENIED. 3. Plaintiff's Motion for Order to Show Cause for a Preliminary Injunction #7 is DENIED. Clerk is directed to send to the Warden at Pontiac a copy of this Order so the Warden is made aware of Plaintiff's allegations regarding lack of medical care. 4. Plaintiff's Motion Reporting Serious Potential Harm and Danger #9 is DENIED. 5. Plaintiff's Motion for the Court to Order Part-Time Request #10 is DENIED. 6. Pursuant to its merit review of the Complaint under 28 U.S.C. Section 1915A, the Court finds that Plaintiff's Complaint states an Eighth Amendment claim for failure to provide adequate gender dysphoria care, and a separate claim for failure to treat Plaintiff's left arm conditions. Plaintiff SHALL FILE A STATUS REPORT stating if he wants to 1) pursue both claims, in which case the Court will sever them, triggering in Plaintiff the obligation to pay another filing fee, or 2) pursue only one claim, in which case Plaintiff must state which case Plaintiff wants to pursue. Failure to file the required status report within 14 days will subject this case to dismissal for failure to prosecute. See written Order.(VH)

March 10, 2025 Opinion or Order TEXT ORDER Entered by Judge Michael M. Mihm on 3/10/25 granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $7.02. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full.
