July 31, 2025 Opinion or Order TEXT ORDER: DENYING Plaintiff's #22 Motion for Leave to File Amended Complaint. Federal Rule of Civil Procedure 15(a)(2) provides "a party may amend its pleading only with the opposing party's written consent or the court's leave. The court should freely give leave when justice so requires." Plaintiff seeks to add additional facts concerning interactions with Defendants that occurred between May 2025 and June 2025. Upon review of Plaintiff's motion and amended pleading, the Court agrees with Defendants that the addition of new facts that occurred after he filed his original Complaint do not relate to his original claims for violations of the Due Process Clause, equal protection Clause, and the Illinois Uniform Conviction Information Act. In this instance, justice does not require granting Plaintiff's motion because it is highly likely that he will discover additional facts during discovery that may or may not be relevant to his claims. At this stage of the litigation, Plaintiff need only plead enough facts concerning the alleged violations to survive a Rule 12(b)(6) motion. Therefore, facts obtained after the alleged violations occurred and Plaintiff's initiation of this lawsuit would not be relevant. Entered by Judge Michael M. Mihm on 07/31/2025. (DS)

May 30, 2025 Opinion or Order TEXT ORDER: Plaintiff has filed a Voluntary Motion for Dismissal of Defendants Angela Hilt and Debbie Conroy pursuant to Federal Rule of Civil Procedure 41(a)(2). (D. 14). Rule 41, however, does not speak of dismissing individual claims or parties in a suit; "it speaks of dismissing 'an action' which is to say, the whole case." Taylor v. Brown, 787 F.3d 851, 857 (7th Cir. 2015) (emphasis added). While the Seventh Circuit has recognized that even though "some district courts in this circuit allow the voluntary dismissal of individual claims under Rule 41(a)," the courts should "use Rule 15(a) instead." Id. at 858 n. 9; see also Dr. Robert L. Meinders, D.C., Ltd. v. United Healthcare Serv., Inc., 7 F.4th 555, 564 n. 4 (7th 2021) ("we again remind parties and district courts that Rule 15(a) is the better course for voluntarily dismissing individual parties or claims"). However, due to the procedural posture of the case and Plaintiff's pro se status, the Court finds that it is in the interest of judicial economy to GRANT Plaintiff's #14 Motion rather than ordering Plaintiff to file an amended complaint. See, e.g., Manuel v. Nalley, No. 15-CV-783-SMY-RJD, 2017 WL 6593703, at *1 (S.D. Ill. Dec. 26, 2017) ("While the Court acknowledges the plain reading of [Rule 41], it finds that dismissing defendants..., rather than ordering amendment of the Complaint, is in the interest of judicial economy considering the posture of this case."). Accordingly, Defendants Angela Hilt and Debbie Conroy are dismissed without prejudice and the Clerk is DIRECTED to terminate them from this action.
