TEXT ORDER entered by Judge Michael M. Mihm on 8/21/2025. Plaintiff filed suit on 5/7/25. On 7/11/25 the Court denied his request to proceed without prepayment of fees and allowed him 21 days to pay the filing fee, warning that if he did not do so this action would be dismissed. Plaintiff has not paid the $405 filing fee. Therefore, this case is DISMISSED without prejudice pursuant to Federal Rule of Civil Procedure 41(b). (VH)

TEXT ORDER entered by Judge Michael M. Mihm on 7/11/2025.. Plaintiff's Application to Proceed in District Court Without Prepayment of Fees #7 is DENIED. "Courts have broad discretion in assessing the sufficiency of an applicant's evidence of poverty, especially when it comes to prisoners, who have fewer demands on their income because prisons provide them with food, clothing, shelter, and medical care." See Maboneza v. Kincaid, 798 F. App'x 19, 23 (7th Cir. 2020) (inmate with $1,500 in income in preceding six months was not destitute). Based on the balances shown on Plaintiff's trust ledger #10 at the time of filing, and the fact Plaintiff's current daily expenses are being paid by the state, the Court finds Plaintiff is able to pay the filing fee. See 28 U.S.C. Section 1915(a). Within 21 days of this Order Plaintiff shall pay the $405.00 filing fee in full to the Clerk. If Plaintiff does not do so this case will be dismissed without prejudice.
