TEXT ORDER ONLY: On January 5, 2026, the Court found Petitioner Brenda Morris's application to proceed in forma pauperis ("IFP") deficient because she failed to provide the Court with the required trust fund account statement. The Court provided her with twenty-one days to remedy that error and warned that failure to comply would result in the dismissal of this case without prejudice. See Text Order on 1/05/2026. Petitioner has failed to comply with that Order and the time to do so has now passed. Thus, Petitioner's #3 Motion for Leave to Proceed IFP is DENIED, and this case is DISMISSED without prejudice pursuant to Federal Rule of Civil Procedure 41(b) for failure to pay the filing fee. TEXT ORDER ONLY: On December 24, 2025, pro se Petitioner Brenda Morris filed a #3 Motion to Proceed in forma pauperis (IFP). Petitioner is currently an inmate at Livingston County Jail where she has been incarcerated for over seventeen months. See D. 2 at 6. A prisoner seeking to proceed IFP must "submit a certified copy of the trust fund account statement (or institutional equivalent) for the prisoner for the 6-month period immediately preceding the filing of the complaint or notice of appeal[.]" 28 U.S.C. 1915(a)(2). Petitioner is currently an inmate at Livingston County Jail, yet she has failed to provide this statement with her IFP Motion. Thus, the Court ORDERS Petitioner to provide the necessary trust fund account statement within twenty-one days of this Order.
