October 21, 2025 Opinion or Order TEXT ORDER: GRANTING pro se Plaintiff Sabrina Williams' #5 Motion for Leave to Proceed in forma pauperis ("IFP") pursuant to Section 28 U.S.C. Section 1915. The Court previously denied Plaintiff IFP because she failed to sign and thus, certify her statements regarding her financial insolvency and because her accompanying complaint failed to state a claim. D. 3. In doing so, the Court provided Plaintiff an opportunity to correct these deficiencies. Id. Upon a review of Plaintiff's #5 Motion for IFP and her #4 Amended Complaint, the Court finds Plaintiff has done so. The #5 IFP Motion was submitted under penalty of perjury and sufficiently demonstrates that Plaintiff should be excused from paying the filing fee in this action. Plaintiff's Amended Complaint also remedies the prior deficiencies set forth in the Court's 10/3/2025 Order. Thus, the Court finds that Plaintiff has stated a claim for purposes of Section 1915A against the named Defendants in their individual capacities under 28 U.S.C. Section 1983. (See D. #4 ); see also Haines v. Kerner, 404 U.S. 519, 520 (1972) (holding federal courts shall hold allegations in a pro se complaint to less stringent standards than formal pleadings drafted by lawyers). The Clerk is DIRECTED to attempt service on the named Defendants pursuant to the standard procedures. Entered by Judge Michael M. Mihm on 10/21/2025. (RES)

October 3, 2025 Opinion or Order Filing 3 ORDER entered by Judge Michael M. Mihm on 10/3/2025. Plaintiff's #2 Motion to Proceed in forma pauperis is DENIED, and her #1 Complaint is DISMISSED without prejudice. Plaintiff may file an amended complaint addressing the above deficiencies by no later than October 17, 2025. If Plaintiff fails to do so, her case will be dismissed with prejudice for want of prosecution. See Fed. R. Civ. P. 41(b). See full written Order. (RES)
