TEXT ORDER entered by District Judge Jonathan E Hawley on 11/19/2025. On 10/20/2025, the Court denied Plaintiff's Petition to Proceed in forma pauperis, directed him to pay the $405 filing fee in full within 21 days, and warned Plaintiff this case would be dismissed if he failed to do so. (Doc. 5). On 11/4/2025, the Court denied Plaintiff's Motion for Reconsideration and again ordered him to pay the $405 filing fee by 11/10/2025. The deadline has passed, and Plaintiff has not paid the filing fee. Therefore, this case is DISMISSED WITHOUT PREJUDICE. Plaintiff remains responsible for paying the $405 filing fee in this case. The Clerk is directed to enter judgment and close this case.(VH)

TEXT ORDER entered by District Judge Jonathan E Hawley on 11/4/2025. On 10/20/2025, the Court denied Plaintiff's Petition to Proceed in forma pauperis because Plaintiff, who has accumulated three strikes under 28 U.S.C. Sec. 1915(g), did not demonstrate that he is under imminent danger of serious physical injury. (See Order, Doc. 5). The Court directed Plaintiff to pay the $405 filing fee by 11/10/2025. Id. Plaintiff now files a Motion for Reconsideration #6 arguing that Beasley v. Marquez, et al. (Case No. 17-4272) does not count as a strike because it was not dismissed on grounds that it was frivolous, malicious, or failed to state a claim. As this Court stated in its Order, Beasley v. Marquez, et al. was dismissed at merit review as barred by the statute of limitations, and the Court assessed a strike. Beasley v. Marquez, Case No. 17-4272, Doc. 7 (C.D. Ill. Nov. 16, 2017). See Jones v. Bock, 549 U.S. 199, 215 (2007) ("If the allegations... show that relief is barred by the applicable statute of limitations, the complaint is subject to dismissal for failure to state a claim...."); Cannon v. Newport, 850 F.3d 303, 307 (7th Cir. 2017) (dismissal of case as time-barred counts as a strike under Sec. 1915(g)); Richards v. Kleinhubert, 263 F. App'x 493, 494-95 (7th Cir. 2008) (same). A motion for reconsideration requires Plaintiff to clearly establish that the Court's ruling was made in error based on a manifest error of law or fact, or by presentation of newly discovered evidence. Lightspeed Media Corp. v. Smith, 830 F.3d 500, 505-06 (7th Cir. 2016). Plaintiff presented no new evidence, arguments, or legal authority in his Motion to suggest that the Court's 10/20/2025 Order was based on a manifest error of law or fact. Plaintiff's Motion #6 is DENIED. Plaintiff is ORDERED to pay the $405 filing fee by 11/10/2025. Failure to do so will result in the dismissal of this case without prejudice (VH)
