TEXT ORDER: On October 24, 2025, the Court entered a Show Cause Order as to why this case should not be transferred to the Northern District of Illinois. On October 24, 2025, the Defendant filed a Response consenting to the transfer of this case to the Northern District of Illinois, Eastern Division, in accordance with the removal statute 28 U.S.C. 1441(a). TEXT ORDER: On October 23, 2025, Defendant filed a #1 notice of removal, seeking to remove Plaintiffs' state court action to this Court. In that notice, Defendant asserts that venue is proper in this Court because the "alleged accident occurred in Henry County, which lies in the Central District of Illinois." But the proper venue for removed actions is not the district in which the incident occurred. Instead, a state court action must be removed "to the district court of the United States for the district and division embracing the place where such action is pending." 28 U.S.C. 1441(a). As the #1 notice of removal indicates, the underlying state court action was filed in the Circuit Court of Cook County, Illinois. (Doc. 1 - 1 at 1.) The U.S. District Court for the Northern District of Illinois would therefore be the district "embracing the place where such action is pending." See About the Court, U.S. Dist. Ct. N. Accordingly, Defendant is required to SHOW CAUSE in writing why this case should not be transferred to the Northern District. Defendant's response must be filed by or on October 31, 2025.
