TEXT ORDER entered by Magistrate Judge Eric I. Long on 2/18/2026. Pursuant to Local Rule 7.1(E), due to the filing of Plaintiff's Amended Complaint #16 , Defendants' Motion to Dismiss #12 is denied as moot with leave to refile. In addition, due to the filing of Plaintiff's Amended Complaint, Plaintiff's Motion to Compel #14 and Defendants' Motion for Miscellaneous Relief #17 are denied as moot. Plaintiff is reminded that he must respond to all future motions or the Court will presume there is no opposition and may rule without further notice under Local Rule 7.1(B)(2). Defendants are reminded that a motion to stay is not granted as a matter of right and that they must participate in the discovery process until an order staying discovery is granted. See Cincinnati Ins. Co. v. Silvestri Paving Co. , 2011 WL 4686437, at *3 (N.D. Ill. Oct. 4, 2011). A Rule 16 scheduling conference will be scheduled once a responsive pleading to Plaintiff's Amended Complaint is on file, although that scheduling conference might be vacated if a renewed motion to stay is granted. Until that happens, both parties are directed to comply with Federal Rule of Civil Procedure 26. (DW)

TEXT ORDER entered by Magistrate Judge Ronald L. Hanna on October 27, 2025: The Court has reviewed Plaintiff's Status Report filed on October 24, 2025, in response to the Court's earlier Order directing Plaintiff to show cause why this matter should not be transferred to the Urbana Division. Plaintiff acknowledges that the Complaint was inadvertently filed in the Peoria Division and expresses willingness to take corrective action pursuant to Civil Local Rule 40.1 and 28 U.S.C. 1404(a). Upon review, the Court finds that the case arises from events occurring in Coles County, Illinois, which lies within the Urbana Division. In the interest of judicial economy and proper venue, and without opposition, the Clerk of Court is DIRECTED to TRANSFER this case to the Urbana Division of the United States District Court for the Central District of Illinois. TEXT ORDER: Plaintiff filed his #1 Complaint in the Central District of Illinois's Peoria Division, but it appears that it should have been filed in the Urbana Division. Civil Local Rule 40.1 provides the divisions of the U.S. District Court for the Central District of Illinois in which complaints and subsequent filings will be filed. See Civil LR 40.1(A) - (D) (explaining that complaints should be filed in the division in which the case arises). Plaintiff's Complaint asserts that "a substantial part of the events and omissions giving rise to Plaintiff's claims occurred... in Coles County, Illinois." Coles County is embraced by the Urbana Division. Thus, the Plaintiff is ordered to SHOW CAUSE in writing, by October 31, 2025, why this case should not be transferred to the Urbana Division of the U.S. District Court for the Central District of Illinois.
