February 4, 2026 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 2/4/2026. Plaintiff has filed a motion asking for leave to appeal in forma pauperis. Title 28 U.S.C. Section 1915(a)(3) provides that "an appeal may not be taken in forma pauperis if the trial court certifies in writing that it is not taken in good faith." Id. An appeal taken in "good faith" is not about the movant's sincerity or motivation. A good faith appeal is an appeal that "a reasonable person could suppose... has some merit." Walker v. O'Brien, 216 F.3d 626, 632 (7th Cir. 2000). The Court has reviewed Plaintiff's motion, his notice of appeal, and the Court's Orders, and the Court does not see an arguable good faith basis for his appeal. Accordingly, the Court certifies pursuant to 28 U.S.C. Section 1915(a)(3) that Plaintiff's petition to appeal in forma pauperis is not in good faith, and his motion #17 is DENIED. If Plaintiff wishes to contest this Court's finding, he must renew his petition to proceed in forma pauperis with the Court of Appeals within thirty (30) days after service of this Order. Fed. R. App. Pro. 24(a). The Clerk of the Court is directed to send a copy of this Order to the United States Court of Appeals for the Seventh Circuit. (KE)

December 29, 2025 Opinion or Order Filing 9 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 12/29/2025. IT IS, THEREFORE, ORDERED: 1. Plaintiff's Complaint fails to state a claim upon which relief can be granted because Defendant is immune from this lawsuit, and allowing Plaintiff to attempt to amend his complaint based upon the facts as alleged by him would be futile. 28 U.S.C. Section 1915A; Fed. R. Civ. P. 12(b)(6). 2. Accordingly, this case is DISMISSED WITH PREJUDICE. The Clerk of the Court is directed to enter judgment in Defendant's favor and against Plaintiff. 3. The Clerk of the Court is further directed to add this case to the "three strikes" list as a possible "strike" against Plaintiff pursuant to the Prison Litigation Reform Act. 28 U.S.C. Section 1915(g). 4. All other pending motions are denied as moot, and this case is terminated. All deadlines and settings on the Court's calendar are vacated. 5. If he wishes to appeal this judgment, Plaintiff must file a notice of appeal with this Court within thirty (30) days of the entry of judgment. Fed. R. App. P. 4(a)(4). 6. If he wishes to proceed in forma pauperis on appeal, Plaintiff's motion for leave to appeal in forma pauperis must identify the issues that he will present on appeal to assist the Court in determining whether the appeal is taken in good faith. See Fed. R. App. P. 24(a)(1)(c); Celske v. Edwards, 164 F.3d 396, 398 (7th Cir. 1999) (an appellant should be given an opportunity to submit a statement of his grounds for appealing so that the district judge "can make a responsible assessment of the issue of good faith."); Walker v. O'Brien, 216 F.3d 626, 632 (7th Cir. 2000) (providing that a good faith appeal is an appeal that "a reasonable person could suppose... has some merit" from a legal perspective). 7. If he chooses to appeal, Plaintiff will be liable for the $605.00 appellate filing fee regardless of the outcome of the appeal. SEE FULL WRITTEN ORDER.(SAG)

December 17, 2025 Opinion or Order TEXT ORDER granting #4 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 12/17/2025. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $44.17. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full.
