Sec 1915A, the Court finds that Plaintiff states an Eighth Amendment claim against Defendants Nikki Rambo, Dr. Rodney Alford, and Mindi Nurse based on their alleged deliberate indifference to his serious medical needs and a First Amendment retaliation claim against Defendant Mindi Nurse for allegedly transferring him to Pinckneyville because he filed grievances. Additional claims shall not be included in the case above, except in the Court's discretion on motion by a party for good cause shown under Federal Rule of Civil Procedure 15. As Defendants have already appeared and answered, no waivers need to be issued. Defendants are directed to file an answer to Plaintiff's Amended Complaint within 21 days of this Order. December 3, 2025 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 12/3/2025. Plaintiff filed a Petition to Proceed in forma pauperis #3 ("IFP Petition"). Plaintiff indicates he receives occasional monetary gifts of between $50 - $300 from his wife. According to Plaintiff's Prisoner Trust Fund Ledger #4 , the balance of Plaintiff's account as of 11/20/2025 was $1,060.49. Between 5/9/2025 and 11/20/2025, $1,200 was deposited into Plaintiff's account, and Plaintiff spent $2,043.19 at the commissary. (Doc. 4). In his IFP Petition, Plaintiff states he has no dependents, debts, or financial obligations. See Maboneza v. Kincaid, 798 F. App'x 19 (7th Cir. 2020) (finding that inmate who had $1,500 in income in preceding six months was not destitute). "Courts have broad discretion in assessing the sufficiency of an applicant's evidence of poverty, especially when it comes to prisoners, who have fewer demands on their income because prisons provide them with food, clothing, shelter, and medical care." Id. at 23. Based on Plaintiff's trust fund balance and the lack of debts or other financial obligations, the Court finds Plaintiff has sufficient funds to pay the $405 filing fee. Plaintiff's IFP Petition #3 is DENIED. Plaintiff is ORDERED to pay the $405 filing fee in full by 12/23/2025. Failure to do so will result in the dismissal of this suit without prejudice, and Plaintiff will still be responsible for paying the filing fee. (VH)
