TEXT ORDER: The Plaintiff filed his Amended Complaint on December 30, 2025 #18 , and has yet to effectuate service. After 90 days passed, the Court sua sponte ordered the Plaintiff, on March 30, 2026, to effectuate service on or before April 29, 2026. He was also warned that failure to do so "may result in dismissal of this action." 19 . The Plaintiff has failed to comply with that Order. Under Federal Rule of Civil Procedure 4(m), "[i]f a defendant is not served within 90 days after the complaint is filed, the court - on motion or on its own after notice to the plaintiff - must dismiss the action without prejudice against that defendant or order that service be made within a specified time." Here, the Plaintiff failed to complete service within 90 days, and then failed to complete service within the additional 30 days that the Court sua sponte provided. TEXT ORDER: DENYING #17 Motion for TRO. On December 5, 2025, the Court dismissed the Complaint without prejudice and instructed the Plaintiff to pay the filing fee in this case. The Court also granted the Plaintiff leave to amend the Complaint. On December 18, 2025, the Plaintiff paid the filing fee and filed a Motion for Temporary Restraining Order. However, to date, the Plaintiff has not filed his Amended Complaint which is necessary component to commencing a civil action. See Fed. R. Civ. P. 3. Accordingly, the Motion for TRO #17 is denied with leave to renew the Motion and the Plaintiff is directed to file his Amended Complaint within 21 days.
