April 21, 2026 Opinion or Order Filing 21 TEXT ORDER entered by District Judge Jonathan E Hawley on 4/21/2026. Plaintiff filed a Motion to Request Counsel #20 asking the Court to appoint an attorney to represent him. "There is no right to court-appointed counsel in federal civil litigation." Olson v. Morgan, 750 F.3d 708, 711 (7th Cir. 2014). When evaluating a Motion to Request Counsel, the Court must consider: "(1) has the indigent plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself?" Pruitt v. Mote, 503 F.3d 647, 655 (7th Cir. 2007). "When evaluating a plaintiff's competence, district courts should normally consider the plaintiff's literacy, communication skills, education level, and litigation experience." Bracey v. Grondin, 712 F.3d 1012, 1018 n.3 (7th Cir. 2013) (citing Pruitt, 503 F.3d at 655). The inquiry is individualized, taking all the relevant facts into consideration, including the stage of the litigation. Navejar v. Igiola, 718 F.3d 692, 696 (7th Cir. 2013). The Court may also consider "the perceived merits ofor likelihood of success onan indigent plaintiff's claims in its decision whether to allocate scarce pro bono counsel resources to the case before it." Watts v. Kidman, 42 F.4th 755, 764 (7th Cir. 2022). Plaintiff states he contacted seven attorneys to request legal representation. Plaintiff attached letters from three attorneys who declined to accept his case to his Motion. The Court finds Plaintiff made a reasonable attempt to secure counsel on his own. Regarding Plaintiff's competence, Plaintiff states he completed some high school courses. Plaintiff states he is seriously mentally ill (SMI) and cannot read or write. Plaintiff states he received assistance from a jailhouse lawyer who is no longer able to help. Plaintiff states he received Defendants' Jury Demand #14 and does not understand why he was not given any forms to fill out for discovery. Plaintiff also states he is housed in segregation and does not have access to the law library or legal books. This case involves an Eighth Amendment claim against Defendants Jilian Crane and Dr. Alfred based on their alleged deliberate indifference to his liver and kidney infection and pain from a stab wound he suffered. The Court entered a Scheduling Order #19 on 4/17/2026, which provides more information about the discovery process. No jury trial date has been scheduled. Discovery closes on 10/19/2026, and dispositive motions are due by 11/17/2026. The Court finds Plaintiff appears competent to litigate this case himself, especially at this early stage of the litigation process. If Plaintiff needs additional time to meet deadlines, he may file a motion for extension of time. Plaintiff's Motion to Request Counsel #20 is DENIED. (VH)

Plaintiff filed a Motion to Request Counsel #4 asking the Court to appoint an attorney to represent him. "There is no right to court-appointed counsel in federal civil litigation." Olson v. Morgan, 750 F.3d 708, 711 (7th Cir. 2014) (citing Pruitt v. Mote, 503 F.3d 647, 649 (7th Cir. 2007)). When evaluating a Motion to Request Counsel, the Court must consider: "(1) has the indigent plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself?" Pruitt, 503 F.3d at 655. Demonstrating a reasonable effort to obtain representation typically requires submitting letters from several attorneys declining assistance and copies of any documents which show Plaintiff tried to find an attorney. See Olson, 750 F.3d at 711. Plaintiff has not demonstrated a reasonable attempt to secure his own lawyer. Because Plaintiff has not satisfied the first prong, the Court does not address the second. Eagan v. Dempsey, 987 F.3d 667, 682 (7th Cir. 2021). Plaintiff's Motion #4 is DENIED with leave to renew. If Plaintiff renews his motion, he is directed to attach copies of letters he sent to or received from prospective counsel, list the attorneys or law firms he contacted, and indicate whether he received a response. January 7, 2026 Opinion or Order TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $9.00. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full.
