April 14, 2026 Opinion or Order Filing 3 TEXT ORDER denying #2 the Plaintiff's Motion for Leave to Proceed in forma pauperis. The Court has reviewed the Plaintiff's Motion which was submitted under penalty of perjury. The Plaintiff indicates that he expects $2,500 in income next month, that he has $800 in cash, $750 in a debit account, and total monthly expenses of $1,730. He does not expect any major changes to his monthly income or expenses or in his assets or liabilities during the next 12 months. He represents that while he has been struggling to survive since his alleged wrongful termination, he "may be nearing stability." It appears the Plaintiff may have incorrectly listed his income amount for the 12 past months combined (he indicates an average monthly income of $10,000 from self-employment and an average monthly income of $11,000 from public assistance for a total monthly income of $21,000 during the past 12 months) and incorrectly listed his gross pay overall rather than his gross monthly pay while employed by Copart (he indicates a gross monthly pay of $65,000). It also appears he failed to include $850 in monthly expenses in his total monthly expenses calculation. Nevertheless, the other information provided indicates the Plaintiff is able to pay the $405 filing fee. The Court specifically notes that the Plaintiff's annual income is over the $15,960 HHS Poverty Guidelines for a household of 1. The Plaintiff must pay the full $405 filing fee by 4/28/2026.
