TEXT ORDER entered by District Judge Sue E Myerscough on 5/28/2026. Plaintiff was ordered to file an updated petition to proceed without prepayment of fees by May 22, 2026, upon his release to the community, and was warned that noncompliance would result in dismissal of this action without prejudice. Plaintiff has not filed an updated petition, and the deadline has passed. Separately, Plaintiff's original complaint was struck on April 14 because it included only a case caption and a few sparse sentences. The Court allowed Plaintiff 21 days to replead, and on May 1 on its own motion the Court allowed Plaintiff another 21 days to replead and warned him that noncompliance would result in dismissal of this action without prejudice. No amended complaint has been filed. Because Plaintiff has not filed an updated petition to proceed without prepayment of fees as ordered, and because Plaintiff has not filed an amended complaint, this case is DISMISSED without prejudice pursuant to Federal Rule of Civil Procedure 41(b). Judgment to enter for Defendants. (VH)

TEXT ORDER entered by Magistrate Judge Douglas J Quivey on 5/1/2026. Since filing this action Plaintiff has resumed residence in the community. The Court must reassess the appropriateness of allowing Plaintiff to continue to proceed as a poor person. The Court will do so by reassessing Plaintiff's financial situation. The Clerk is directed to mail Plaintiff a long form application to proceed without prepayment of fees. Plaintiff must return the fully completed, signed, and sworn form within 21 days of this order or face dismissal of this suit.Separately, although Plaintiff has updated his address, he has not updated his telephone number. Plaintiff shall within 21 days provide the Court with his current telephone number. Noncompliance may result in dismissal of this action without further notice. Finally, the Complaint in this matter was struck from the record on April 14, 2026, because it included only a case caption and a few sparse sentences. Plaintiff was allowed 21 days to file an amended complaint but based on his most recent filings he may not have received that Order. TEXT ORDER granting #2 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $48.73. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 5/28/2026.
