TEXT ORDER entered by District Judge Sue E Myerscough on 8/18/2026. Plaintiff has on three or more occasions filed lawsuits that were dismissed as frivolous, malicious, or for failure to state a claim. Under 28 U.S.C. Section 1915(g) he cannot proceed without prepayment of fees unless in imminent danger of serious physical harm. The Court denied his request to proceed without prepayment of fees and allowed him thirty days to pay the $405 filing fee in a written Order, Dkt. #7 . Plaintiff's deadline to pay the filing fee passed on August 13, 2026, without payment. Plaintiff filed a Notice, Dkt. #10 , indicating he does not intend to pay the filing fee. Therefore, this case is DISMISSED without prejudice pursuant to Federal Rule of Civil Procedure 41(b). Judgment to enter for Defendants. Plaintiff's remaining pending motions are MOOT.(VH)
