IT IS THEREFORE ORDERED THAT: (1) Because Plaintiff did not file an amended complaint within 14 days after the claim against William Volk was dismissed without prejudice, the claim agains t William Volk is dismissed with prejudice and William Volk is terminated as a party to this case. (2) Defendant's Motion for Summary Judgment 24 is GRANTED. Judgment is entered in favor of Defendant and against Plaintiff on Plaintiff's Complaint 6 . (3) This case is terminated.
