Plaintiff's motion to proceed in forma pauperis 4 is GRANTED. Plaintiff's motion to request counsel 3 is DENIED. Pl aintiffs Amended Complaint 9 is dismissed for failure to state a claim pursuant to FRCP 12(b)(6) and 28 USC Sec 1915A. Dismissal shall count as one of three allotted strikes pursuant to 28 USC Sec 1915(g). Any appeal must be filed with this Court within 30 days of the entry of judgment. If Plaintiff files appeal, he will be liable for $505 appellate filing fee irrespective of the outcome. This case is closed; clerk directed to enter judgment pursuant to FRCP 58 and record Plaintiff's strike in the three-strike log. See written Opinion.
