TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Plaintiff's trust fund ledgers indicate he has no funds to make an initial partial payment of the filing fee. Pursuant to 28 U.S.C. Section 1915(b)(4), the initial partial filing fee is waived. The agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. TEXT ORDER entered by Judge Harold A. Baker on 7/10/2018. Plaintiff Keller filed a letter in Case 18-CV-2174 on June 26, 2018, and the Court directed the Plaintiff to file a Complaint within 14 days identifying individuals who he holds liable for denying him his medication. On July 5, 2018, Plaintiff Keller sent the Court a Complaint identifying certain individuals he holds liable for the denial of his medication. A new case was opened, 18-CV-2185, and the Complaint was filed in that case. The Court has determined that the Complaint should have been filed in Case 18-CV-2174. Accordingly, the clerk is directed to (1) file the Complaint and Petition to Proceed In Forma Pauperis in Case 18-2174, (2) prepare a Notice of Case Opening in Case 18-2174, (3) set a merit review deadline thirty (30) days out in Case 18-2174, and (4) close Case 18-2185 without collection of an additional filing fee. The clerk is also directed to enter this text order in both cases. The trust fund ledgers requested in Case 18-2185 should be filed in Case 18-2174 when they are received.
