TEXT ORDER entered by Magistrate Judge Eric I. Long on 10/31/2018. On October 29, 2018, Plaintiff filed a Motion for Leave to Proceed in forma pauperis #2 . Plaintiff's Motion indicates she owns a home with an estimated value of $80,000. Plaintiff lists over $4,000 a month in income, as well as $600 a month in expenses on clothing and dry cleaning alone. A litigant wishing to proceed in forma pauperis must show that he is unable to pay required filing fees. 28 U.S.C. Section 1915(a)(1). Courts have wide discretion to decide whether a litigant is impoverished. Merritte v. Templeton, 493 Fed. Appx. 782, 784 (7th Cir. 2012). Although the Plaintiff's application seems to show that her expenses outweigh her income, Plaintiff has approximately $850 in checking and savings accounts, as well as an abnormally large monthly clothing budget. Considering the income Plaintiff has available and the monthly expenses she reports, the Court cannot determine that Plaintiff is impoverished. Accordingly, Plaintiff's Motion for Leave to Proceed in forma pauperis #2 is DENIED. Plaintiff is required to pay the filing fee is she wishes to proceed with her Complaint. (KE, ilcd) |
