On March 4, 2019, Plaintiff was sent the court's form motion to proceed in forma pauperis for individuals not presently incarcerated and was directed to complete and return it within 21 days. Plaintiff was cautioned that failure to comply would result in dismissal of his case. See Text Order dated 3/4/19. More than 21 days have passed and plaintiff has failed to submit his new application for IFP. Accordingly, this case is dismissed, without prejudice, and closed. No judgment to enter. (KE, ilcd)
March 4, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 3/4/2019. Plaintiff has filed a motion to proceed in forma pauperis (IFP), but he has submitted a form intended for individuals who are currently incarcerated. Therefore, Plaintiff's motion to proceed IFP #3 is DENIED with leave to re-file. The Clerk of the Court is directed to send the appropriate form to Plaintiff. If Plaintiff wishes to proceed IFP, he must complete the form that the Clerk is sending to him with the information necessary for the Court to consider his motion. Plaintiff is reminded that, if his application contains inaccurate information and if his allegation of poverty is untrue, the Court will dismiss this case. Plaintiff must either file his new IFP motion or pay the $400 filing fee within twenty-one (21) days from the date of this Order. March 4, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 3/4/2019. Plaintiff's motion to request counsel #5 is DENIED. The Court cannot consider the merits of his motion until Plaintiff shows that he has made reasonable efforts to find counsel on his own. Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). This Court typically requires a litigant to attach the responses that he has received from lawyers declining the request to represent him. Plaintiff has not attached any responses to his motion to request counsel or demonstrated that he has made any efforts to find counsel on his own. Plaintiff may renew his motion for counsel, but if he chooses to do so, he should attach the responses that he has received from the lawyers that he has contacted where those lawyers decline his request to represent him. In addition, Plaintiff should set forth his educational level, his work experience, his litigation experience (if any), and any other facts relevant to whether he is competent to proceed without an attorney. Finally, the Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after conducting a merit review of the complaint.
