TEXT ORDER entered by Judge Colin Stirling Bruce on 9/10/2020. Plaintiff's motion for reconsideration #7 is DENIED. Plaintiff has offered no new arguments or evidence with which to convince the Court that it erred in holding that the Younger abstention doctrine applied in this case and that this case should be stayed pending a resolution of Plaintiff's criminal cases that are currently pending in state court. Therefore, Plaintiff's motion for reconsideration is denied. Because the Court has stayed this case, Plaintiff's motion to include additional claims (which is, essentially, a motion to amend his complaint) #8 is DENIED as moot. (KE, ilcd) |

Filing 6 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 8/10/2020. Pursuant to its merit review of the Complaint under 28 U.S.C. Sec 1915A, the Court finds that Plaintiff's Complaint states two claims: (1) an excessive force claim and (2) a Due Process medical claim. Any additional claims shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The Court will not effect service of process upon Defendants. Instead, this case is STAYED pending a resolution of Plaintiff's related state court criminal matters and pending further Order from this Court. The Court will lift this stay in this case after defense counsel in Case Number 19-2283 files a motion to lift the stay in that case at the conclusion of Plaintiff's related state court criminal matters. The Court directs the Clerk to administratively close this case. See Thomas v. Wardell, 951 F.3d 854, 858 n. 3 (7th Cir. 2020) ("Administratively closing a case moves it to a court's inactive docket, while the court retains jurisdiction for purposes of future activities on the case."). All pending motions are denied as moot, and all entries on the Court's calendar are vacated. See written order. (KE, ilcd) |

TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 7/28/2020. Plaintiff`s trust fund ledgers indicate he has no funds to make an initial partial payment of the filing fee. Pursuant to 28 U.S.C. Section 1915(b)(4), the initial partial filing fee is waived. The agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office. (KE, ilcd) |
