TEXT ORDER entered by Judge James E. Shadid on 10/13/2020. On September 3, 2020, the pro se Plaintiff filed a complaint pursuant to 42 U.S.C. 1983, but he failed to either pay the required filing fee or file a motion to proceed in forma pauperis #1 . Therefore, the Court advised Plaintiff he must do one or the other within 21 days or his case would be dismissed. See September 4, 2020. The Court's entry was returned to the Clerk of the Court noting Plaintiff was no longer at the address provided. The Court extended the deadline to September 28, 2020, to allow Plaintiff time to provide his new address. See September 14, 2020, Text Order. Plaintiff has failed to take any further action. Therefore, this lawsuit is dismissed for failure to prosecute with due diligence and failure to pay the filing fee.(SAG, ilcd)
