TEXT ORDER entered by Judge Harold A. Baker on 7/7/2021. Plaintiff's trust fund ledgers disclose a current balance of $976.60. See #7 . The ledgers also disclose that Plaintiff spent approximately $550.00 at commissary and sent $250.00 to individuals outside the prison in the 30 days preceding the date he filed this lawsuit. The Court finds that Plaintiff is not indigent for purposes of 28 U.S.C. Sec. 1915. Plaintiff's Petition to Proceed in forma pauperis #3 is DENIED. See Lumbert v. Ill. Dep't of Corrs., 827 F.2d 257, 260 (7th Cir. 1987) (a litigant who "thinks that a more worthwhile use of his funds would be to buy [commissary items] than to file a civil rights suit has demonstrated an implied evaluation of the suit that the district court is entitled to honor."). Plaintiff shall pay the $402.00 filing fee in full within 21 days of this Order. Failure to do so will result in dismissal without prejudice. (KB)
